农作物秸秆焚烧的环境法律政策研究

焚烧农作物秸秆不仅破坏了土壤的有机质,而且污染了农村的环境,还能引起严重的呼吸道疾病,对公众健康具有很大的危害。现阶段,我国治理秸秆焚烧方面的法律法规还不完善,倡导秸秆综合利用的方式也较单一。为了更好地引导秸秆综合利用,有必要借鉴国外经验,结合我国具体的国情,建立秸秆综合利用补贴制度、设立秸秆焚烧专项示范基金、实行秸秆焚烧总量控制制度、划定明确的焚烧量以及控制焚烧量的时间表并且严格追究焚烧者的污染责任。

Burning agricultural straw not only destroys soil＇ s organic matter, but also pollutes the environment around, and has great harm on public health causing serious respiratory diseases. At the present stage, the laws and regulations about regulating agricultural straw burning are not fully developed in China, and the methods of advocating making comprehensive use of agricultural straw are simple. In order to better guide the comprehensive utilization of agricultural straw, it is necessary to set up the subsidy systems of comprehensive utilization of crop straw, establish the special funds for it, implement the control total amount of straw burning system, define clear burning capacity and the schedule of controlling such a capacity, and hold the burning polluter＇s strict pollution liability accountable.
