金融改革下的民间融资规范化探析

由于我国一直缺少能够完整地规范民间融资的法律,造成司法部门在解决此类民间融资纠纷时处于棘手处境。《温州市民间融资管理条例》的颁布及实施,标志着地方性民间融资活动逐步阳光化、合法化。然而,在新的经济格局和金融环境下,民间融资壮大发展以及对经济发展推动作用的发挥,皆有赖于建立一个有效、合理、科学的法律制度。结合法经济学理论,从供给平衡方面探析民间融资的成因及相关作用,最后提出构建民间融资制度的方法和途径。

The Research of the Legal Regulation of Private Finance --On the Dual Perspective of Economics and Law

Based on information economics, this thesis investigates the principles of risk sharing in private financing. This thesis reviews the revolution of private financing theory and explains the definition of Pareto efficient. Under the different complete levels, it defines necessary and sufficient conditions of private financing activities among members if Pareto efficient is available. At last, it expounds the principles that should be followed in perfecting our country＇s private financing policies, and puts forward some financing legal system countermeasures and suggestions.
