关于国际信托的承认机制及其评析

信托制度凭借其成熟的财产管理优势,被许多大陆法系国家承认并为其所用.由于英美法系的财产法与大陆法系的物权法和债权法存在本质的差别,因此有关国际信托的法律冲突较其他领域就更为复杂.针对信托领域存在的差异,两大法系国家在实践中应认识到国际信托承认的客观必然性、<海牙信托公约>存在着关于国际信托承认范围的折中性以及关于国际信托承认的基本范畴的限制性.只有对<海牙信托公约>进行评析的基础上,才能更好地解决国际信托的承认机制问题.
