论知识保护的产权化路径

知识作为一种重要的无形资产,为其提供保护的必要性无庸置疑,而对其保护却存在着不同的路径选择。市场化的机制较之非市场化的机制具有一定的比较优势,但两者相互补充,不能以前者否定和取消后者。由于知识产品具有抽象的有用性、人为的稀缺性、可予界定性等财产方面的特征,满足了主体对客体的可控度的要求,从而使知识的产权化得以实现。要正确认识知识产权的私权属性,兼顾私权和公益的平衡。

On the Propertied Approach in the Protection of Knowledge

There is no doubt that we should provide some protection for knowledge which is a very important invisible asset,but there are different approaches to achieve that goal.Market oriented mechanism has a comparative advantage compared to non-market oriented mechanism although these two approaches are complementary.Because of the attributes of abstract usefulness,artificial scarceness and possible demarcation,the propertied approach can be followed successfully.We should hold a reasonable view on the private nature of the intellectual property and strike a balance between the private and the pubic side.
