生态建设视野下的林业行政指导

在对林业行政指导进行概述的基础上,阐述林业领域所采取的指导.帮助、建议.动员、宣传.劝告、调和.协调、鼓励.奖励5种非强制性的行政指导方式,指出林业领域实施行政指导具有促进政府职能转变、有利于改善"官民"关系、弥补林业法律规范不足、提高林业行政管理效率等效果,但同时存在实施方式不够多样化、运作过程不够规范、操作形式发生异化、运用范围较为局限4个突出问题,提出实施方式有待增多、运行程序亟待规范、运用范围有待扩展、应充分尊重相对人的选择4条林业领域行政指导法治化的完善路径。

The state's laws and policies has made some of the provisions on forestry administrative guidance,forestry administrative guidance usually takes guidance,providing knowledge,technical assistance,suggestion,advice,coordination,incentives and other non-coercive means to carry out.Forestry administrative guidance in line with the pattern of changes in government administration,improving the relationship of "Government and the people",made up for the lack of forestry laws and regulations,improve the efficiency of the forestry administration.But there are also existing some problems such as not variety in implemented ways,not regulate the process,operation in the form of alienation,using the more limited scope of such issues,should be increased through the implementation modalities,standardized operational procedures,respect for the relative who choose to expand the scope of application of methods to solve them.
