| 摘 要： | 夫妻财产约定是现代社会常见的一种解决夫妻财产问题的方式,但是当前我国立法中没有对夫妻财产约定的公示问题予以规定。公示制度的缺失在现实中造成了诸多不利影响,对约定的双方以及第三人的利益构成威胁,因此在立法中有必要引入夫妻财产约定公示制度。本文通过系统分析我国的有关法律制度,得出了登记是我国当前可以采用的一种合适的夫妻财产约定的公示方式的结论,并进一步对登记机关的设定、登记的程序等问题做一理论探讨。
