| 摘 要： | 刑罚的好坏也要看效果。如果不看社会效果，刑罚的目的就不是惩治犯罪、预防犯罪、改造罪犯，刑罚制度的设计就有缺陷，就存在需要改进的地方。从周克华案件入手，可分析刑罚的功效性社会学效果，并探索能否达到这么一种社会效果：刑罚是一种与罪犯的沟通方式，而这种沟通的最终目的是通过惩戒帮助罪犯忏悔，使罪犯认识自己行为的后果，并承担自己应当承担的法律责任。

| Abstract: | The stand of punishment of crime depends on its effect.Without the social effects,the purpose of criminal law is not to punish the criminals,prevent crimes and reform criminals,so the design of the penal syetem is flawed.From the Zhou kehua case,to discuss the social effect of the punishment of crimes,try to reach sunch a social efect：Punishment is a way of commnnication with the criminals.The ultimate goal of the communication is to help the criminals to repant,realize the consequences of their actions,and assume their social responsibility. |
