调—控:经济法坛又一说——兼评李昌麒教授“需要干预说”

本文通过对李昌麒教授关于经济法的“需要干预说”进行分析,认为该说明显带有移植资本主义国家关于经济法的“干预说”的色彩,且“需要”一词不适于定义。本文力图从国情、国体、经济、政治等方面揭示经济法应反映国家对宏观、社会及市场经济问题的直接控制和间接调节的本旨,从而提出经济法“调-控说”,并试以之为基石构筑经济法学和法律体系。

Regulation - Control:A New Theory in Economic Law

Professor Li Changqi' s "Theory of Need Intervention" about economic law obviously has the colour of "Theory of Intervention" about economic law in capitalist countries, and the word "Need" isn' t suitable for definition . Our country' s economic law should reflect the real intention that the country directly control and indirectly regulate macroscopic, social and market economic problems. Therefore, this paper puts forward "Theory of Regulation - Control of economic law. Rebuilding the system of economic jurisprudence and economic law, taking Theory of Regulation - Control" as the cornerstone.
