关于集体建设用地直接入市流转的分析和思考

摘    要:伴随我国工业化和城市化的快速发展,农村集体建设用地的资产价值日益凸显,流转大量存在,已是不争的事实。而法律却严格限制集体建设用地流转,导致了农村集体建设用地流转的失序与混乱。通过对集体建设用地流转模式和存在问题的分析得出,集体建设用地直接入市是一种制度创新,并对其进行了理论上的分析。最后提出了规范集体建设用地流转对策。

Abstract:With the rapid development of industrialization and urbanization,the asset value of rural collective construction land is gradually protruded.It is an indisputable fact that large amount of construction land were transferred.However,although the usufruct transfer of the collective construction land is strictly limited by the law,disordered transfers of collective construction land are still existed.Through analyzing the transfer pattern and existed problems in collective construction land transfer,the author believes that the direct transfer of collective construction land is an institutional innovation.A theoretical analysis is made to this transfer mode and some countermeasures are proposed for regulating the transfer of collective construction land.
