| 摘 要： | 刑法在环境保护中的突出效果,使得各国对环境刑事立法给予了高度重视。中国1997年《刑法》在第六章第六节专门设置了"破坏环境资源保护罪",实现了中国环境刑法的跨越式发展。但是,面对日益严峻的环境保护形势和不断高发的环境犯罪,中国环境刑事立法应当确立对环境法益进行直接保护的原则,通过完善环境刑事立法体系、科学界定环境犯罪既遂的判断标准和完善环境刑法的刑种等,重新构建中国环境刑事责任制度,以充分实现环境刑法在环境保护中的重要作用。

| Abstract: | The obvious effect of criminal law in environment protection has made most countries in the world pay great attention to the legislation of environmental criminal law.The offence of ＂ruin the environment and resources＂ was settled specially in Chinese Criminal Code,Chapter 6,Section 6,which reflects the leap development of environmental criminal law.However,facing the severe environmental problem and high rate of environmental crimes,we should set forth a principle that provides direct protection for the environmental legal interest.Through improving the criminal legal system,defining the standard of consummated environmental crime scientifically,perfecting the classification of offence,and reconstructing the system of environmental criminal liability,we could make full use of environmental criminal law. |
