也谈环境侵权责任构成的分歧

环境侵权作为民事侵权的一种,在性质上属于特殊民事侵权行为。但是对于该特殊侵权行为的责任构成要件,无论是民法通则还是最近新出台的侵权行为法都没能统一标准,致使学界对于违法性要件、无过错要件、因果关系的推定和损害事实要件等都存在较大分歧。

Environmental infringement as a tort,it is a special tort in nature.However,when it comes to the constituent elements of this special tort,whether civil law or tort law introduced recently failed to form an uniform standard,which leads to many different theories about the constituent elements of environmental infringement formed in academia,and the big differences exist in elements of the illegality,no fault elements,the presumption of causation and damage elements especially.In this article,the author intends to discuss their views of these differences.
