| 摘 要： | 现行我国宅基地使用权流转试点的转权模式和保权模式各具利弊,但都难以解决流转的市场化与行政化的矛盾,宅基地使用权流转仍处于法律困境。汶川地震灾后,随着农村房地产灾后恢复重建用地方式的转变,都江堰市设计了以联建为主的味江模式。该模式结合成都市农村产权交易改革,强调宅基地的生存保障功能和宅基地权益的独立性,拓宽了宅基地使用主体范围,在现行法律框架下推动了宅基地使用权流转模式的创新。
