| 摘 要： | 商标是企业品牌战略的核心和载体,是企业的重要无形资产。在企业的国际化发展中,企业可以利用商标权进行担保融资。商标权的国际担保融资是一个涉外民商事行为,由于各国担保制度的差异,因此需要根据具体情形确定法律适用,并依据准据法的规定完成融资担保的创设和实现。

| Abstract: | Trademark is the core and carrier of enterprise′s brand strategy and is enterprise′s important intangible property.In the process of international development,enterprise can use the trademark to guarantee financing.The international secured financing of trademark right is an act involving foreign elements.Because of the difference of every country′s security laws,we should choose applicable law and complete the creation and realization of financing security according to applicable law. |
