论农村土地承包经营权的征收

在现行土地征收制度下，失地农民的权益得不到维护，为此应确认土地承包经营权为独立征收客体。土地承包经营权的物权化、农村特有的土地权利结构以及土地征收行为性质的转变，为完善土地承包经营权征收制度提供了理论和现实依据。针对土地承包经营权转让、互换、转包、出租及入股等流转形式，征收时应予区分并准确确定征收补偿的对象。
