Abstract:From the legal policy and the practical case of short-term residential construction land use right renewal,it can be seen that the automatic renewal of the residential construction land use right does not exclude the payment of the renewal fee.Therefore,it is particularly critical and important to study the calculation plan of the expiry and renewal cost of the right to use the residential construction land.The objective of renewal cost of the right to use residential construction land should be land area of dwelling houses and the computational methods should include key elements like various time-points of different prices of renewal objective,renewal period,the public and private owners’quota of the growth in land price,free renewal area and progressive rates for excess area.The time-points of renewal objective consist of dynamic time-point(signing time of contract for state-owned construction land use right)and static time point(time of expiration of the right to use residential construction land)and both of them have their relevant price.Furthermore,the results of three computational methods for dynamic time-point,static time-point and the combination of both should be compared and determined by various factors like affordability of homeowners,fiscal revenue,etc.
