| 摘 要： | 公共利益的实体界定是难以实现的,为此从程序上对公共利益进行界定成为必要的选择。公民参与对公共利益的界定,符合现代民主理论与实践的要求,并有利于各方对公共利益的接受、实现实质法治、控制行政裁量权。为实现公民参与对公共利益的界定,有必要进行制度上的建构及作出合理的限制。
