农村土地承包经营权入股的风险问题分析

农村土地承包经营权入股，是指在确保农村土地集体所有权性质不变的前提下，农户以家庭土地承包经营权为资本投入到公司中，以公司化的方式对土地经营实行规模化运作，从而最大限度地发挥土地的增值效益。自2007年7月重庆市工商行政管理局出台关于土地流转的规范性文件以来，农村土地承包经营权入股引起人们极大的关注。笔者认为，在目前情况下，土地承包经营权入股存在着经济、法律和政策的一系列风险。在实践中探索这一问题时必须慎重。
