| 摘 要： | 网络版权和公众权之间由于彼此扩张带来了利益冲突问题。本文在参考欧美立法以及我国现行版权法相关规定的基础上,从经济、哲学以及人权的视角出发,主张建构一种利益平衡机制,即相关方对网络版权用益平衡的对立统一。

| Abstract: | The network and the digital technology has changed our copyright law greatly.It not only changes the way of use of traditional works, but the way of transmission.This paper,on the basis of surveying the conflict of benefit between the network copyright and public rights,attempts to build a benefit mechanism of balance which is a kind of unification of opposite.What's more,by comparing the copyright legislation of Europe,America and China,this paper poses some proof in the view of economics,philosophy and human rights. |
