论中国传统社会伦理的法律化

中国传统法律的儒家化表现在两个方面 ,一是法律的伦理化 ,另一个是隐藏在法律伦理化过程中的伦理的法律化。由于法律和道德在起源上相同 ,且调控范围交叉 ,社会功能互补 ,这使得伦理的法律化过程常常被法律的伦理化所遮蔽。然而伦理的法律化有其自身的特点和表现 ,究其实质 ,是统治者通过将伦理规范扩大化为法律的方式 ,来达到最大化控制人的思想和行为的目的 ,即中国政治思想史上的“阳儒阴法”。从这一角度理解 ,伦理的法律化反映的是社会意识形态对主体权利的进一步制约 ,强化了中国法律文化专制性的一面。
