| 摘 要： | 我国设立参与分配制度的目的在于弥补破产主体有限性的缺陷，但由于其与破产制度在功能和价值目标等方面的差异，使得参与分配制度在实践中存在诸多的弊端，如举证责任难以落实、不利于提高执行效率等。本文分析了该制度存在的缺陷及原因，并设想从设立目的、实施条件、分配顺序等方面对其进行完善。

| Abstract: | China's participation distrbution system is established in order to make up for the loss of limited bankruptcy.It's difficult to make sure the burdern of proof and increase the lawsuit efficency in judicial practice,and so on,because it differs from bankruptcy system in their functions and value aims.By analysing its defects and reasons,the author points out that this system can be perfected from value aim,practicing condition and distribution order. |
