论政府信息公开制度中政府信息的界定与公开

随着我国民主法治进程的不断加快,政府信息公开制度逐渐受到越来越多的重视,实践中如何界定某一信息是否为政府信息以及如何判断是否应当公开该政府信息成为行政机关依法行政的重要一环。笔者认为界定政府信息的前提是准确判别政府信息的公布主体,界定政府信息的关键是真正厘清政府信息的形成方式,界定政府信息的重点是正确认定政府信息的存在形式。同时,公开政府信息的难点是要处理好政府信息公开与不公开之间的关系。如此方契合建设法治政府、阳光政府的应有之义。

Issues Concerning Government Information and Disclosure of Government Information

As the process of democracy and the rule of law is accelerating in China,the government information disclosure system has attracted more and more attention.In practice,how to define government information and how to determine whether the government information shall be disclosed is a crucial point.This paper discusses concepts and factors related to these issues.
