| 摘 要： | 以“感情破裂”为离婚法定标准的规定在1980年被第一次写进《中华人民共和国婚姻法》(以下称《婚姻法》),2001年《婚姻法》修改后仍坚持了这一原则。本文在其产生及存在意义给予肯定的情况下,建议用“婚姻关系破裂”代替“感情破裂”作为离婚的法定标准,并系统讲述了此建议的理论依据与现实意义。

| Abstract: | Emotion break, taking as a legal justification for divorce, was firstly put down to "Marriage Law of the People's Republic of China"(following briefly refer to Marriage Law) in 1980. Revised "Marriage Law" in 2001 still adheres to this principle. Under the situation of affirming its appearance and existence, this paper suggests to use "marriage relation break" as a legal justification for divorce instead of "emotion break". The authors also systematically elaborate the theoretical gist and actual significance of this justification. |
