资源型城市可持续发展的法律支持

目前,我国资源型城市可持续发展立法存在的问题,主要体现缺乏矿产资源保护的单项立法,矿产资源环境监管立法体制不佳,采矿权人、探矿权人的监督制度不健全,法条笼统可操作性差、法律制度空白点多等方面。加强资源型城市可持续发展的立法,要坚持可持续发展的原则,开展矿产资源的专项立法和地方立法,强化资源型城市环保立法措施,改革矿产资源管理体制,坚持依法行政,加大执法力度。

Legal Support on Sustainable Development of Resource-based Cities

Nowadays,in legislation concerning sustainable development of resource-based cities in China,there exist the following problems,such as lacking of individual legislation on protection of mineral resources,imperfect in legislative system on environmental supervision on mineral resources,incomplete in control system on mine owners and exploration-right holders,too general and hard to use the articles of laws,and too many blanks in the laws.Thereby,the government should hold the principle of sustainable development to enact special and local legislations on mineral resources,increase legislation on environmental protection on resource-based cities,reform management system on mineral resources,take administration by law and increase law enforcement.
