什么是好的管制者?——对新加坡公用事业的法定机构的实证分析

本文以新加坡公用事业的监管体制为研究对象,重点对法定机构的形成发展从理论和实证两方面作了较细致的研究,认为在考虑信息不对称和利益集团对管制机构的俘获能力,新加坡公用事业的监管机构是好的管制机构,具备了好的管制机构的基本条件,进一步分析了好的管制机构在现有公用事业的市场条件的管制领域和重点,结论认为新加坡法定机构在监管上的成功主要是依靠了国有体制的主导地位、独立的司法裁量权、法定机构在行政权力和监督权力的一致性、较薄的科层制和政府承担资源分布不均导致的外部性成本。尽管新加坡监管体制本身具有一定的特殊性,但是,它至少为我们提供了一个好的监管者的参照系。

How to Be the Good Regulator——Theories on Empirical Analysis on Legal Authorities of Singapore Public Utilities

Focusing on the regulation authorities of Singapore public utilities,this paper examines the origins as well as the development of those legal authorities from both theories and empirical studies,and concludes that regulators of Singapore public utilities are good when considering asymmetric information and capability of interest groups to capture regulators,and meet the requirements as good regulators.Further,this paper examines what regulators should regulate and emphasize on.And conclusion is reached that success of Singapore regulators mainly relies on dominant state-owned system,independent justice power,consistency of the legal authorities in executive rights and regulation rights,flat hierarchy,and externality cost resulting from unfair distribution of resources but held by government.Though Singapore regulation system is unique,it's a good reference for us to act as good regulator,at least.
