土地征收补偿纠纷是当前多发的一类典型争议.从土地征收补偿费用总体性质和各组成部分性质的界定着手,按照土地征收补偿费用确定和落实的程序,依次对纠纷的三个层面,即整体征收补偿纠纷、土地补偿费在集体经济组织之间的分配纠纷、农村集体经济组织与其成员间分配土地补偿费纠纷进行针对性分析,讨论法律救济的具体适用.着眼于实践当中的操作性要求,对土地征收补偿程序的立法完善提出意见和建议.

Legal Remedies for the Disputes of Compensation for Land Expropriation

Disputes about compensation for land expropriation have almost become the order of the day. To begin with, this paper puts a definition on land compensation fees as well as it components. Generally, there are three aspects on the related disputes. The first is the overall compensation disputes. The second is the distribution about the land compensation fees between the rural collective economic organizations. The third is the fees distribution of rural collective economic organizations and its members. This paper discusses the specific application of legal relief. With a view to the requirements of operation in practice, this paper puts forward some suggestions with a view to improving the legislation on land expropriation compensation procedure.
