英国PPP/PFI项目融资法律的演进及其对中国的借鉴意义

近年来,中国PPP项目进入爆发式增长期,PPP项目实施中出现的问题引起了理论界和实务界对PPP法律问题的关注。PPP项目融资是有别于传统抵押融资、担保融资的新型融资模式。本文以英国PPP/PFI项目融资法律和相关政策的发展、演进为视角,重点关注其中的融资法律问题,进而为中国完善PPP立法提出意见和建议。

Evolution of UK PPP/PFI Financing Law and Its Enlightenment to China

In recent years, PPP projects have entered into a rapid developing period in China. Both the theoretical and practical groups have paid high attention to the legal issues arising from the projects. PPP project financing is different from the traditional mortgage financing or secured financing. This thesis focuses on the financial issue under PPP model, with the view of the development of legislation on PPP/PFI in UK, especially on the financial part, and the puts forward proposal for the related legislation in China.
