| 摘 要： | 我国现行农村土地产权的制度安排所存在的缺陷，既不利于农民土地权益的保护，也制约着农村土地征收制度的深化改革。在现有法律支持下，坚持现行土地所有制、明晰农村土地产权关系和确立产权代表、赋予农民集体土地所有权完整的权能，是经济社会协调发展对维护农民土地权益的要求。

| Abstract: | The defects in existing rural land property right system in China not only have an adverse effect on the protection of farmers＇ land rights and interests, but also restrict the deepening reform of rural land expropriation system. In existing legal system, it＇ s necessary to maintain existing land ownership, clarify rural land property right relations, appoint representative of property right, and give whole powers and functions to farmers＇ collective ownership of land to promote harmonious development between economy and society and safeguard farmers＇ land rights and interests. |
