中国西部地方环境立法问题初探

地方环境立法是我国西部大开发顺利进行的重要保障 ,但西部现有地方环境立法已不能适应西部大开发的需要。其中主要表现为 :地方立法不健全 ,立法不科学 ,重点不突出 ,制度创新性差 ,缺乏主动性、灵活性和前瞻性。在西部大开发中 ,要加快地方环境立法的速度 ,建立科学的立法体系 ,实现西部地方环境立法与国家环境法律、国际环境法律的接轨 ,结合西部特点强调以防为主 ,明确各部门的职责及公众参与的范围和途径 ,并在立法中明确公民环境保护的法定义务

A Probe into the Local Environmental Legislation in Western China

Local environmental legislation is an important factor to guarantee the successful operation of the Western Development in China. But the local environmental legislation at present can't meet the demand of the western development, such as lack of sound local legislation and scientific legislation method, key points, systematical innovation, flexibility, activeness and foresightness. In the western development, we should quicken up the speed of local environmental legislation, set up scientific legislation system and fulfill the combination of western local environment legislation, national environmental law and international environmental law. Moreover, based on the western characteristics, we shall mainly emphasis on the prevention of environment, clarify the function of each department, the scope and means of public participation, as well as expressly prescribe the citizen's statutory duty on environmental protection.
