构建CEPA独创性争端解决机制的思考

CEPA作为我国实质性区域经贸合作重要制度的安排，实施至今时近四年，并不断通过《补充协议》的形式丰富和发展双方的合作领域、范围，但其对争端解决机制的规定一如既往的简洁。作为世界上第一个由一个主权国家内两个行政区域在WTO框架下建立的区域经济一体化组织，CEPA主体、调整对象和性质均具有鲜明的特征，因此，不可能直接适用WTO或现存的其他争端解决机制，而必须构建起一套独特的争端解决机制。
