合宪,还是违宪——对我国《人民检察院组织法》第3条的质疑

我国《人民检察院组织法》第3条关于“检察长在重大问题上不同意多数人的决定,可以报请本级人民代表大会常务委员会决定”的法律规定,与我国现行宪法规定和宪法精神相抵触。它违反了国家机关之间权限的宪法定位及人民检察院独立行使检察权的宪法原则,违反了监督主体与监督对象分离的宪法精神。本文最后提出了修改的建议并提出了应转变认识、建立行之有效的违宪审查制度,以杜绝此类现象。

Constitutionality, or Contrary to the Constitution——Reflection on the Article 3, Organic Law of the People''''s Procuratorates of the People''''s Republic of China

The Article 3,Organic Law of the People's Procuratorates of the People's Republic of China,defines that the dispute may be reported to the standing committee of the people's congress at the corresponding level by the chief procurators for submission to the standing committee of the people's congresses for decision when chief procurators don't agree with opinions of majority of procuratorial committee in major issues.It is contrary to the Constitution of the People's Republic of China.It disrupts constitutional division of powers of state organs,and violates constitutional principle that People' s procuratorates shall,in accordance with the law,exercise procuratorial power independently.It violates the principle that subjects of supervision and objects of supervision are separable.The paper proposes the suggestion to modify the Article 3 and proposes that constitutional faulty realization on constitution must be transformed and effective judicial review system must be established in order to prevent unconstitutional law.
