论构建和谐社会的法治路径

和谐社会的内涵包括两个层面:一是人与自然的和谐;二是各社会主体关系的和谐。司法制度对法律所规范和调整的社会关系起着基础性的矫正和保障作用:公权力与私权利界限的确认以及对公权力的有效制约有赖于司法最终保障,私权利主体之间的纠纷也有赖于司法来化解。司法制度的完善是法治进程中构建和谐社会的重要着力点,从权威司法观念的树立、实现法院审判权、责、信的统一、保障法官独立行使审判权等方面对司法制度予以完善,是构建和谐社会的必由之路。

On constructing harmonious society's legal route

There are two areas in the Connotation of a harmony society,the harmony between human and nature and the harmony between the social subjects.Judicial system plays an essencial role of Correction and Security to the social relations which regulated by laws:the confirmaton of the border between public powers and individual rights;the effective constraints of public powers and the disputes between individual rights,all of the above rely on a good judicial system.The perfection of the judicial system is the focus of the harmony society which is ruled by law.the only way to the construction of a harmony society is to establish judicial authority,to realize the Consistent of responsibility,power and trust for the judicial powers and to protect independent trial.
