论现行反垄断法适用之界限划分

我国现行反垄断法存在适用界限模糊的缺陷,特别是对处于垄断地位的大型国有企业所做的限制竞争行为,其法律性质难以确定。针对不同原因产生的五类垄断形式,建议反垄断法在制裁垄断行为时充分考虑企业限制竞争的原因及背景,确定具有合法垄断地位经营者经营行为的合法外延,制定不同种类垄断形式下企业限制竞争行为的具体评判标准,从而对反垄断法适用界限予以更为具体、明确的划分。

The Research on the Delimitation of the Current Antimonopoly Law Application
