| 摘 要： | 在国内外文献追踪的基础上,本文设计了一个在厂家和商家合作博弈下形成独占交易不同形式的分析框架,通过对博弈参与者的成本、收益和利润核算体系的考量,概括出我国目前存在的四种独占交易形式,它们存在着不同程度的垄断性。对这四种独占交易进行福利分析后,认为应依据效率与公平兼顾的原则,对其合理认定,制定力度不同的规制方案,依不同行为进行不同程度的规范、惩罚和豁免等。
