工伤精神损害赔偿探析

解析现行《工伤保险条例》可知,其规定的工伤待遇中没有精神损害赔偿这一项。但根据我国现行的相关法律法规规定,工伤中的精神损害能否依法要求赔偿存在4种情形,有的可以得到赔偿,有的则不能。而且依精神损害赔偿请求权指向的对象不同,工伤精神损害赔偿争议的仲裁与诉讼又分3种情形。为维护工伤职工的正当权益,我国有关工伤精神损害赔偿的实体立法和程序立法应进一步配套和完善。

Exploring Analysis on the Spiritual Damage Compensation in Occupational Injury

Analysis on the occupational injury insurance regulations finds that occupational injury treatment is without spiritual damage compensation.There are four cases to asking for spiritual damage compensation according to the positive law. Some can be compensated,and some are not. And according to the spiritual damage compensation claim to the different defendants,there are three kinds of situations in the dispute of arbitration and litigation. In order to maintain the legitimate interests of occupational injury worker,the substantive law and procedural law must be further complemented and improved in our country.
