农用地征地补偿中的物权处置

农用地征收实质上农用地的所有权由农民集体经济组织向政府转移的行为，因此征地补偿时就要充分靠考虑农用地所有权的物权属性，给予合理的补偿。本文在分析了农用地所有权的物权性质和新增建设用地地租组成的基础上，进一步阐述了土地开发权所带来的增值收益应在农民集体与政府之间合理分割，分割的原则就是按照带来增值的投资主体的不同进行合理的分配，最后得出结论，即征地补偿应为农用地的所有权价格与土地增值收益分割值之和。

Possession Disposal in the course of Compensation to the Farmland Requisition

The essential of land expropriation is that collectivity-owned land is transferred from farmer collectivity to government, so the property of farmland should be considered when the standard is set up and obtain rational compensation. On the base of analyzing the property of farmland and the land rent constitution of construction land in this paper, the author clarify that the land value increment after expropriation should be shared between the farmers and government according to the different investors and at last come to a conclusion that the compensation standard of land expropriation should consists of the value of land ownership right and a part of the land value increment after expropriation.
