边穷地区刑事审判执行体现被害人意志和利益问题

在我国当前的刑事形势下,犯罪嫌疑人、被告人合法权益保护无论在立法层面上还是司法实践中都得到了贯彻,但站在对立面、作为犯罪行为指向的被害人的利益保护却显得滞后和苍白,案件判决执行情况等与被害人要求相距甚远。因此,如何在边穷地区的刑事司法中切实有效地体现被害人的意志和保护其利益,是我国立法、司法部门亟待解决的问题。

The Problem of Protecting the Rights and Will of the Victims in Trial and Judgment of Criminal Cases in Remote Poor Areas

In the current criminal situation,the legal rights protection of the suspects and the defendants is exercised both legally and in practice.However,in contrast,the rights protection of the victims lags far behind and the judgments and execution are also far from victims＇ requirements.Therefore,how to show the will of victims and protect their rights effectively in the criminal cases in remote poor areas is a problem calling for immediate solution for our legislative and judicial organs.
