我国环境治理的制度成本解析

文章用经济学成本分析方法,对我国现行环境法律制度的设计及实施进行了探讨。认为:当前,我国环境法律制度作为环境治理的正式制度,其供给和需求不足且交易成本过大,因而存在一定程度的制度虚设、制度失灵现象和环境治理不力。究其因,是由于我国经济社会的发展特征及诸多因素所致。环境法律制度供需的最优化应体现为公平与效率的充分合理化及交易成本的最优化,以此作为我国环境法律制度创新和改进的目标非常重要。
