| 摘 要： | 东道国公司的外籍雇员提供服务是否属于GATS框架下的自然人流动尚属一个不确定的问题.将这种服务提供模式纳入GATS很有必要,这对于增进发展中国家和世界整体福利都是有益的.从长远来看,直接将其纳入GATS协定文本或附录最彻底;从目前来看,最可行的方案是将各国的外籍工人引进计划纳入各成员方的具体承诺表.

| Abstract: | It's still not clear whether or not the GATS framework covers the involvement of foreign employees in host country firms to supply services as the movement of natural persons. The article is in favor of the inclusion of such a mode of employment-based relationship under GATS, because it is beneficial to improve the overall welfare of developing countries and the whole world. In a long run, the most crucial step is to include it directly in the text or appendix of the GATS; in a short term, the most feasible approach is to involve the employment schedule of foreign employees in each country into each member's list of specific promises. |
