| 摘 要： | 2010年以来,中国对稀土元素产品的出口限制引起世界的广泛关注,虽然稀土出口限制措施与2009年中国有关限制若干原材料出口措施案中的涉诉措施有类似之处,实质均是中国与其他WTO成员方之间对关键资源的攻守博弈,但在具体形式上又有发展。本文将结合WTO规则及其最新的争端解决实践,深入探究其实质与发展,试图提出应对措施,以期能更好地对这一潜在贸易争端做好充分准备,进而维护中国的正当利益。
