水权制度框架下的滨海新区水权刍议

相对于水资源所有权,水权是一个独立的概念,我国水权交易经历了由绝对禁止到法律有条件地允许的过程。滨海新区地理位置特殊,水资源需求量大,水权制度的健全和发展直接关系到滨海新区的建设进程。在国家政策法规的引导下,遵循法的公平和效率原则,逐步完善区域内水量分配、水权初始分配和水权市场制度,积极探索水权转让的途径,为我国水权法律制度的完善起到示范和促进作用。

Study of Water Right Law in the Binhai New Area

Compared with water resources ownership,water right is an independent concept.Water right transaction has experienced the change from absolute prohibition to conditional permission by law in China.The Binhai New Area is in a special geographical position and its demand for water resources is large,so the perfection and development of water right system is directly relative to the construction of the Binhai New Area.Under the guidance of China＇s laws and policies,according to the principles of equity and efficiency,it＇s necessary to gradually improve water resources distribution system,initial distribution system of water right and market system of water right and to actively explore the approach to water right transaction in the Binhai New Area,which will play a role in the perfection of China＇s legal system of water right.
