虚拟财产的法律保护探析

虚拟财产是指在网络环境下,模拟现实事物,以数字化形式存在的、既相对独立又具独占性的信息资源。虚拟财产与现实财产存在天然的联系,鲜明地反映了现实社会的利益关系,因而应当纳入法律的调整范围。网络虚拟财产性质的界定对于保护网络游戏玩家的合法权益非常重要。文章分析了虚拟财产的性质,认为网络虚拟财产是一种物权化的债权,以此为出发点,对于网络等变化很快的科技类伴生品,最好用一些临时性、快捷、有效的司法解释型立法来对其进行相应的法律规范。
