规制效率、反垄断法与行政垄断行业改革

行政垄断行业,大多是国有经济占控制地位的关系国民经济命脉和国家安全的行业,《反垄断法》对合法经营予以保护,因而对行业行政垄断表现形式的研究特别重要。行业行政垄断有三种一般的表现形式——政府部门不适当的行政进入壁垒、规制机构低效率的规制行为、行政垄断企业滥用其市场支配地位的垄断行为;通过实证以及调查研究发现,后两者是当前行业行政垄断的主要表现形式,为此给出行业行政垄断改革的相关建议。
