对微软垄断诉讼案的思索

微软垄断诉讼案为我们评迷哈佛学派、芝加哥学派与新奥地利学派关于垄断与竞争关系的争论，质疑反经济性垄断在当代的合理性，提供了极好的切入点。反垄断不等于反大企业，也不限制企业通过正当的经营行为获得市场支配地位及高额利润，它所保护的绝不是弱小企业。反垄断反的是不正当的垄断与竞争行为，而义要把握效率根本这个标准。

Reflections on the Anti- trust Case of Microsoft

Based on the anti-trust case of Microsoft,this paper reviews the famous debate on the monopoly-competition relationship among the Harvard,Chicago and new Austria schools.It calls about doubt in the rationality of the anti-economic monopoly.The author holds that anti-monopoly is not equal to against big company,not to restrict the company to win the market ascendancy and high profit,not to protect puny enterprise.Anti-monopoly is to oppose the unfair behavior of monopoly and competition and must keep the criterion of efficiency.
