| 摘 要： | 当前我国正处于经济社会转型时期，金融领域的犯罪呈现出多发、高发态势。结合当前社会涌现的一些新形式的金融违法案件，对目前案件办理中存在发现难、取证难的法律原因进行了分析，并对这些金融违法案件的法律适用问题进行了探讨，认为金融违法案件必须同时注重刑法的法益保护和人权的保障机能。

| Abstract: | China is now in an economic and social transformation with financial crimes showing a multiple and high trend. Based on some new forms of financial law-violating cases, an analysis is conducted of the legal reasons for difficulties in finding crimes and evidence together with probing into the law application for current financial crimes. It is believed that the financial law case handling must be accompanied with the legal interest protection of the criminal law and human rights |
