| 摘 要： | 在对民事诉讼实行检察监督的过程中 ,由于民事诉讼立法对抗诉制度及抗诉权限规定得不够明确 ,致使检察机关与人民法院在对诸多问题的认识上产生偏差 ,并在行使抗诉权与审判权的过程中产生摩擦和冲突 ,严重影响了民事检察监督体制的顺畅运行。本文就其中存在的四个问题进行了具体的分析 ,并对如何解决这些问题提出自己的见解

| Abstract: | During the process of supervisity civil lawsuit People's procuratorate and People's court have divergences on many problems due to the obscure regulations in civil lawsuit on the limits of authority of counterappeal.Thus conficts arise when the power of supervision and judicial authority practised and the demotratic system of practising the power of supervision suffers a loss.This essay is an analysis on the five problems about that and also some personal opinions on how to resolve these problems are presented. |
