关于疫情影响下赶工费用的计算思路探讨

在建设项目实施过程中,经常遇到工期延误的情况。在非承包人原因(如不可抗力等)导致工期延误的情况下,为保证工期,发包人常要求承包人赶工,由此往往出现赶工费用计算的问题。以2020年新型冠状病毒肺炎疫情为例,由于受到疫情影响,大量建设项目进度滞后。随着近期国内疫情渐渐好转、各地的建设项目纷纷复工并全面展开,为避免因建设项目延期交付导致的各类损失,赶工及赶工费用如何计算和确认,是建设项目各方面临和亟待解决的问题。鉴于本次新冠肺炎疫情基本被认定为不可抗力3],在发包人提出赶工的前提下,对于如何定量计算赶工费用的问题,文章从分析不可抗力的认定依据入手,结合实际案例,将费用分为新增人员进退场费及人员施工降效补偿费用、新增机械设备进退场费、材料增加费、临设增加费与现场管理费等五方面,以此为基础列出了赶工费用计算思路,为各位专业人员解决此类问题提供了参考性建议。

Discussion on the Calculation of Rush Work Cost under the Influence of Epidemic Situation

Under the circumstances of construction project implementation,the construction period is often delayed.In order to ensure the construction period with delay of construction period caused by non contractor reasons(such as force majeure),the employer often requires the contractor to rush to work,which often leads to the problem of how to calculate the rush cost.Taking the novel coronavirus pneumonia epidemic in 2020 as an example,due to the impact of the epidemic,a large number of construction projects are lagging behind.With the gradual improvement of the epidemic situation in China and the resumption of construction projects all over the country,and to avoid all kinds of losses caused by delayed delivery of construction projects,how to calculate and confirm the cost of rush work is an urgent problem faced by all parties of construction projects.In view of the fact that this epidemic event is basically regarded as force majeure,how to quantitatively calculate the cost of rush work under the premise that the employer proposes to rush to work?In this paper,starting from the analysis of the basis for the determination of force majeure,combined with the actual case,the cost is divided into five aspects:the cost of new personnel entry and exit with the cost of personnel construction efficiency reduction compensation,the cost of new machinery and equipment,the cost of material increase,the cost of temporary facilities and site management fee.On this basis,the calculation ideas of rush cost are listed,which provides reference for professionals to solve such problems Suggestions for examination.
