| 摘 要： | 住宅建设用地使用权如何自动续期的问题是理论界和实务界讨论的热点问题,由此也引发对该制度权利义务框架设计其他不合理性之处的思考。本文强调民法权利义务的配置过程中关键应考虑公平与自由原则,并提出完善住宅建设用地使用权制度的建议。

| Abstract: | Automatic renewal of residential construc tion land use rights has been the hot topic of the theoretical and practical circles.It also lead to ponder over other unreasonable places of system design framework of rights and obligations.This paper emphasizes that the principle of fair and freedom is the key to the configuration of civil rights and obligations.Further more,I will offer a proposal of how to improve the residential construction land use rights system. |
