| 摘 要： | 我国是利用BOT投资较早的发展中国家之一 ,但是我国BOT投资的发展却比较缓慢。其原因虽然是多方面的 ,但是与BOT投资相关的法律冲突问题是关键的制约因素。针对BOT投资领域、投资主体、国际借贷及风险担保等法律问题 ,应尽快制定我国的BOT投资立法 ,修改BOT投资部门规章 ,完善BOT投资的地方性法规 ,逐步放宽我国关于国际项目融资的限额规定

| Abstract: | Although China is one of the developing countries that earlier used the BOT-type investment, but BOT in China has a slow road to progress. This article gives some advice on how to legislate the BOT national law by analyzing the cause of formation of problems on the market entry conditions, project company, international loan and assurance of BOT-type. |
