基于多层次利用的海域多层使用权研究

在现代科学技术的推动下，人们已经开始对不同深度、不同层次的海域空间进行有效利用，而海域多层次利用中的使用权分层界定问题也已成为海域进一步有效利用的限制条件。首先，文章对海域资源多层次利用的意义和条件进行了研究；其次，基于海域的多层次利用，将海域使用权界定为水面使用权、水体使用权、海床使用权、底土使用权以及综合使用权五个层次，并探讨了海域多层使用权的取得和行使；最后，对海域使用权分层界定以及行使过程中应建立什么样的规则来约束不同海域使用权人行使其各自权利的问题进行了研究。

The Research on Multilayer Usufruct of Sea Areas Based on the Multilayer Utilization

With the impulse of the modem science and technology, people have began to utilize the different depth and levels sea areas, and the problem of separating usufruct into layers in sea areas of multilayered use has become the restricted conditions for more effective use of the sea areas. First, the paper analyzed the significance and condition about the multilayer utilization of sea areas. Next, based on the multilayer utilization of sea areas, in this paper the sea areas should be separated usufruct into five layers, such as the right to use of surface, the right to use of water, the right to use of subsoil, the right to use of seabed, the right to use of synthesizes. The paper also discussed how to obtain and exercise the multilayer usufruct of sea areas. Last, the paper analyzed what kind of rules for restricting the respective rights of different people.
