| 摘 要： | 假冒他人专利是一种严重的侵犯专利权的行为 ,历来是我国有关立法打击的重点之一。自 1984年之后颁行的三部《专利法》以及新《刑法》都对假冒他人专利的行为或假冒专利罪作了规定。尽管如此 ,关于假冒专利仍然存在许多值得研究的问题。

| Abstract: | Patent forgery is a severe infringement of patent rights,which has be en one of the major crimes Chinese authorities have been trying hard to crack do wn. Even though the three laws covering the issue of patent promulgated since 19 84 and the newly enacted Criminal Law have all laid down provisions concerning t he crime,there are still a lot to be addressed. This article will give a theore tical analysis of the categories of forgeries and concise definitions of their p roperties. |
